Scott K. McClain (Litigation, Personal Injury, Financial Services)

Scott K. McClain is a Partner with the firm's Financial Services Group and litigation department. Mr. McClain practices in the area of commercial litigation and regulatory compliance for the financial services industry, with a concentration in anti-money laundering compliance for money services businesses, including check cashers, money transmitters, electronic payments processors, and depository institutions servicing the MSB industry. He has represented clients in all aspects of business litigation, including contract disputes, negotiable instruments/UCC, shareholder actions and employment matters. He serves as an MSB industry representative to the federal Bank Secrecy Act Advisory Group under the auspices of the U.S. Treasury Department. Mr. McClain regularly lectures in the financial services compliance area, and has authored several industry manuals and an Internet-based training curriculum which has helped train over 40,000 financial service industry employees nationally.

Mr. McClain also serves as the chairman of the firm's Personal Injury Practice Group and has developed a specialization as a plaintiff's advocate in complex tort matters, including wrongful death, product liability, medical malpractice, construction-site defects and motor vehicle collisions. One of Mr. McClain's representative cases includes Jerkins v. Anderson, 191 N.J. 285 (2007), which established critical new standards for student safety and supervision, and led to a $6 million dollar settlement - one of the largest recoveries relating to student safety/supervision in the State of New Jersey. Mr. McClain's courtroom experience includes trials in State and U.S. District Courts, including personal injury and commercial matters, chancery litigation and appellate work.
