Case History - A child sustained catastrophic injuries after unsupervised dismissal from school. The 9-year old boy was allowed to leave school grounds, even though his older brother or parents had not yet arrived to meet the child. Later the youth was struck by an automobile and sustained spinal chord injuries rendering him quadriplegic. After appealing the case to the New Jersey Supreme Court, Winne Banta's Scott K. McClain recovered a $6 Million settlement for the family - one of the largest recoveries involving school negligence in State history.
As a result of the case, the New Jersey Supreme Court established critical new State-wide standards improving student safety and supervision.
